The Llamoja case provided parameters for motivation, so some of these parameters were used in the arbitration field to clarify when a motivation is adequate or inadequate. The purpose of this academic article is to explain why the use of certain parameters established in Llamoja for the appeal for annulment of the award is appropriate or inappropriate. First of all, in the center of the presentation, explain what parameter is not used in the annulment appeal: Qualified reasons. Secondly, I develop what parameters are used and focus on a) Lack of motivation or apparent motivation b) Lack of internal reasoning motivation, c) Deficiencies in external motivation; justification of premises and d) Substantially incongruent motivation. Additionally, I focus on the parameter of insufficient motivation to determine three main reasons why I consider it a problematic parameter. The first is that it analyzes the substance of the matter, the second that it presents the subjectivity of the judge, the third that it does not comply with the fact that the motivation is a guarantee of jurisdiction. Finally, I conclude that insufficient motivation implies a high degree of subjectivity, which is why its use in arbitration is not appropriate.
