Which factors explain corruption in public procurement of instraestructural projects? Which problems are found in the governance of this sector and which role does economic power plays? This thesis seeks to develop a response to the phenomenon of corruption in the public procurement of infraestructural projects. It is argue that the characteristics of the weak governance of the infraestructure system in Peru and the corporate capture of the institutions in charge of public procurements, explain the high degree of corruption and collusion present between 2002-2016. By analyzing the “Club de la Construcción” case and using a qualitative methodology, this thesis makes a first approach to the phenomenon of corruption in public procurement and the role of private actors in collusion with politicians and public workers. It was evidenced the existence of a changing and manipulable regulatory framework, where corruption persist as an informal institution thoughout the process of public procurement. In this sector, the lack of autonomy for decision- making within institutions where political and business influence is observed, and the weakness of government control institucions prevail. On the other hand, in the private sector was found a high concentration of economic power in a group of enterprises that used legal and illegal capture mechanisms (lobby, revolving door, party financing and brivery), acting as a cartel, to develop a network of influences within the State. As a consequence, they gained cost overruns of the assigned infrastructure project at the expense of the quality of the infrastructure, the legitimacy of the public institucions and reputation of the construction sector.
