The main problem of the case is to determine the denaturalization of the amounts granted by ESSALUD to its workers, under different concepts, mainly those amounts granted under the concept of uniform, in order to establish if from such denaturalization, a labor custom can be configured in favor of public sector workers, taking into account that, institutions such as ESSALUD, are governed from predetermined public budgets. To determine this, Article 19 of the Law on Compensation for Time of Service was analyzed, which allows us to distinguish when we are facing the correct granting of a working condition, which, in the present case, did not occur, there were indications that allowed us to infer that we are facing the granting of concepts with remunerative character. Based on this premise, we examined the elements that make up the labor custom, a benefit that has no legal basis, but has been conceptualized and developed by the doctrine and jurisprudence, determining that it is possible that the elements that make up the labor custom are generated in the public sector. Likewise, the principle of budgetary balance was analyzed, whose jurisprudential development allows establishing that the public budget is not an absolute limitation for the granting of the labor custom in favor of public workers
