Resumen: Dentro de nuestro ordenamiento jurídico, el Estado establece los parámetros y
lineamientos para la actuación administrativa en aras del bienestar e interés
común. En ese marco resulta vital que la Administración actúe sobre la legalidad,
con las facultades que la ley puede atribuirle, sometido a la normativa. Por tanto,
no es factible que alguna Entidad se atribuya capacidades que no le
corresponda, vulnerando facultades y competencias, lo que a todas luces
deviene en ilegal y en perjuicio de los administrados.
Bajo ese contexto, mediante la Resolución 0027-2022/SDC-INDECOPI, el
Indecopi tuvo la oportunidad de brindar mayor desarrollo respecto a las razones
por las cuales consideraron ilegales las exigencias denunciadas contenidas en
el Reglamento Nacional de Vehículos del Ministerio de Transportes y
comunicaciones dentro del procedimiento de barreras comerciales no
arancelarias dejando en evidencia la importancia del cumplimiento normativo.
Asimismo, a pesar de comulgar con la decisión recogida en la resolución de
segunda instancia en mención, consideramos que los efectos jurídicos no deben
reducirse solo al beneficio de los denunciantes y terceros interesados que se
apersonaron al procedimiento, sino que la inaplicación de las exigencias
denunciadas debe ser extendidas para todos los administrados en general, sin
distinción. En consecuencia, determinar algún tipo de diferencia entre agentes
económicos por un acto administrativo con impacto en actividades de comercio
exterior, contraviene el propósito de la economía social de mercado amparado
en nuestra Constitución.
Within our legal system, the State establishes the parameters and guidelines for administrative action for the common welfare and interest. Within this framework, it is vital that the Administration acts on legality, with the powers that the law may attribute to it, subject to the regulations. Therefore, it is not feasible for any entity to attribute to itself capacities that do not correspond to it, violating its faculties and competencies, which is clearly illegal and detrimental to those who are administered. In this context, by means of Resolution 0027-2022/SDC-INDECOPI, Indecopi had the opportunity to further develop the reasons why they considered illegal the denounced requirements contained in the National Regulation of Vehicles of the Ministry of Transportation and Communications within the procedure of nontariff trade barriers, evidencing the importance of regulatory compliance. Likewise, in spite of agreeing with the decision contained in the second instance resolution, we consider that the legal effects should not be reduced only to the benefit of the complainants and interested third parties who appeared in the procedure, but that the non-application of the requirements denounced should be extended to all those who are administered in general, without distinction. Consequently, determining some kind of difference between economic agents by an administrative act with an impact on foreign trade activities, contravenes the purpose of the social market economy protected in our Constitution.
