In the jurisprudence 310/2023, the Constitutional Court had admitted the claim of constitutional grievance, for which it was presented through an appeal for protection by the peasant community of Asacasi under the representation of Hipólito Tarapaqui. Wedges against the Geological, Mining and Metallurgical Institute; the Ministry of Energy and Mines; and the Regional Directorate of Energy and Mines of Apurimac. This, according to the plaintiff, indicates that the mining concessions would have been approved without prior consultation having been previously carried out. However, the plaintiff alleges that he exhausted previous judicial remedies before the Cotabambas Mixed Court of the Superior Court of Justice of Apurímac, which declared his claim inadmissible for failure to meet deadlines; and in the second instance, before the Superior Court of Justice of Apurímac, which ended up declaring the claim unfounded. Although, for the Constitucional Court it indicated that the recognition of the plaintiff as a peasant and native community would not have been valued, so it could assert a series of special rights that were known to it, in compliance with article 89 of the Political Constitution. from Peru 1993; in particular the right to prior consultation in this case. So the omission of legal recognition deprived him of the right to vote, which, despite not being binding, was an essential requirement that had to be met for the authorization of the mining concession.
