The business activities of the State have been a topic of divided opinions due to the subsidiary nature incorporated in article 60 of the Constitution of 1993. The case under study centers on the debate that arises when the State engages in activities with apparently social purposes or public power. The main objective is to analyze whether the activity denounced before the administrative headquarters, which comprises the pilot and civil aeronautical personnel training service provided by the Civil Aviation School of the Peruvian Air Force, constitutes State intervention in the market through business activity, and to determine whether this activity constitutes an act of unfair competition under the violation of regulations as per numeral 14.3 of article 14 of Legislative Decree No. 1044, the Law for the Repression of Unfair Competition. The adopted position concludes that the activity in question violates the constitutional parameters outlined in article 60, leading to the violation of the specified norm. The study is structured according to regulatory instruments analyzed in hierarchical order. Beginning with the fundamental text, followed by the regulatory background in competition law, including Decree Laws Nos 25868 and 26122, Supreme Decree N° 034-2001-PCM, and the current repression norm. Finally, a third group including regulations related to military service and the reported activity, such as Legislative Decree No. 1139 and its regulations, Law No. 29248 (Military Service Law), and Resolution No. 135-2006-MTC/12, mainly.
