This report analyzes the main legal issues arising in the context of a bureaucratic barrier procedure initiated by the company Wi-net Telecom S.A.C against the Municipality of Miraflores in Case No. 000134-2022/CEB, where the legality and reasonableness of the requirement to submit an authorization for the use of third parties infrastructure for the installation of telecommunications infrastructure is discussed. The starting point is the analysis of each of the four (4) means of materialization alleged by Wi-net Telecom S.A.C. in the filing of its complaint in order to determine whether the Commission is competent to rule on them and, consequently, whether they are susceptible to be analyzed in a bureaucratic barrier procedure. Notwithstanding the foregoing, it is the duty of this report to determine the legality of the bureaucratic barrier matter of this discussion. For this purpose, we are going to apply the legality analysis used by Indecopi, which is divided into three aspects: substantive legality-competences, formal legality and substantive legality-compatibility with other regulations. Finally, in a complementary manner, other issues such as the alleged violation of the principle of continuity of infractions by the consecutive fines imposed by the Municipality, among others, will be addressed.
