Altruistic gestational surrogacy is an Assisted Reproduction Technique (TERA) that allows people in the exercise of their sexual and reproductive rights, as well as their right to found a family, to resort to them in order to procreate, mainly, due to infertility problems. The various scientific advances have caused legislators in several countries to become involved in the establishment of legal parameters in order to contribute to this problem. In our country there is only one regulation linked to the subject and that is article 7 of the General Health Law (Law 26842). That article is the only regulation that regulates surrogacy cases in Perú, which, although it does not strictly prohibit this practice, generates different interpretations. This increases due to the fact that there are legal gaps in the regulations related to the subject. For this reason, the purpose of this article is to make a proposal to reform article 7 of the General Health Law regarding surrogacy.
