This article investigates performance evaluation in the context of human resources and labor relations to labor law; since this evaluation essentially seeks to objectively and subjectively measure the skills, performance, achievement of objectives and the behavior of workers within an organization, but apart from a legal framework that embraces it. This article determines that it is necessary to include disciplinary records in the performance evaluation scheme of organizations, analyzing conduct and diligence as mandatory variables to be able to analyze the positive and negative aspects of the worker, since it applies an equitable measurement criterion. and justified at the time of setting payment of bonuses for performance, both vertical and horizontal promotions and in the effective incidence of the fair measure of dismissal that an organization can apply to its workers subject to what is briefly indicated in the regulations, jurisprudence and doctrine found.
