Resumen: La discriminación es una realidad aún existente en nuestro país y que se evidencia en
diferentes aspectos de la vida de las personas, como lo son las relaciones de consumo.
En ese sentido, la comunidad de las personas transgénero es también víctima de
discriminación en el consumo, pero tiene mayor dificultad al momento de exigir la
tutela de sus derechos como consumidores. Por ello, el presente Informe Jurídico
analiza la Resolución N° 3444-2012/SPC-INDECOPI, que revocó la resolución que
emitió la Comisión de Protección al Consumidor del Indecopi, al considerar que no se
había acreditado el trato discriminatorio en agravio de la denunciante, una persona
transgénero. Por lo antes expuesto, el presente trabajo tendrá un marco teórico que
permita definir el concepto de discriminación en el consumo, así como la importancia
del reconocimiento de la identidad de género, para determinar si la normativa en materia
de consumidor incluye dentro de su tutela a las personas transgénero. Luego, se
analizará si la denegatoria de perifonear a una persona transgénero con el nombre que se
identifica y que difiere del consignado en su Documento Nacional de Identidad se
considera un acto discriminatorio al amparo de la Ley de Protección al Consumidor
(vigente al momento de los hechos) y bajo el Código de Protección al Consumidor
vigente. Asimismo, se analiza que si de ser procedente la denuncia, cuáles hubieran sido
las medidas correctivas que corresponderían. Por último, se plantearán recomendaciones
que sirvan de guía para los futuros razonamientos de la Sala en casos similares.
Discrimination is still a reality in our country and is evident in different aspects of people’s lives, such as consumer relations. In this way, the transgender community is also discriminated against in consumer activities and for them, it is more difficult to demand protection of their rights as consumers. For this reason, this Legal Report Analyses Resolution No. 3444-2012/SPC-INDECOPI, which revoked the resolution issued by the Indecopi Consumer Protection Commission, considering that the discriminatory treatment of the complainant, a transgender person, had not been proven. For the above, this paper will provide a theoretical framework to define the concept of discrimination in consumption and the importance of the recognition of gender identity mine whether consumer regulations include transgender people within their protection. Next, it will be analyzed whether the refusal to call a transgender person by megaphone advertising by using the name that they identify with and that differs from that on their National Identity Card is considered a discriminatory act under the Consumer Protection Act (in effect at the time of the events) and the Consumer Protection Code in force. In addition, it is analyzed whether the complaint was admissible, and what corrective measures would have been appropriate. Finally, recommendations will be made to guide the Chamber's future reasoning in similar cases.
