In this sense, the importance of the duty to contribute to the achievement of the social and democratic purposes of the State develops, being often the bank secrecy a limitation for such purposes. In this context and considering the international commitments assumed by the Peruvian State regarding the exchange of information, this article seeks to analyze whether the modifications recently made to the regulation of banking secrecy are in accordance with the Constitution. Thus, after analyzing Legislative Decrees No. 1313 and 1434 considering the regulation of banking secrecy in our country and the concepts previously mentioned, it is concluded that they are not unconstitutional since they do not harm the scope of protection of banking secrecy. However, it is recommended the modification of numeral 5 of Article 2 of the Political Constitution of Peru to put an end to future discussions of the same nature.
