The main problem in this case is limited to determining the scope of the duty of impartiality and independence of the Higher Arbitration Council of the Chamber of Commerce of Lima, as arbitrator appointing entity. In this regard, my position goes against the ruling of the Constitutional Court that declared the amparo claim founded and therefore null and void the Resolutions issued by the Higher Arbitration Council and the award, taking the process back to the time of the appointment of arbitrator Jorge Vega Velasco . This is due to the fact that the Constitutional Court did not apply an objective criterion to be able to determine the alleged partiality and dependency of the aforementioned Council. On the contrary, it applied the theory of appearance, without basing itself on evidence duly proven in constitutional law. For the purpose of this investigation, the main instruments used are the General Arbitration Law, IBA Guidelines on conflicts of interest, Arbitration Regulations of the Arbitration Center of the Chamber of Commerce of Lima, as well as national and international doctrine on the duty of impartiality and independence.
