Abstract: El presente informe se enfoca en las limitaciones advertidas en el desarrollo jurisprudencial
de la Corte Interamericana de Derechos Humanos (en adelante, Corte IDH) para reconocer
expresamente a las personas con capacidad para gestar que no se identifican como mujeres
cisgénero heterosexuales a través de la revisión de la sentencia del caso Artavia Murillo y
otros vs. Costa Rica.
El análisis se complementa con la revisión de las sentencias que versan sobre la vulneración
de derechos de las personas LGBTIQ+ y los derechos sexuales y (no) reproductivos - que
reconocen sobre todo a las mujeres cisgénero como principales afectadas ante su vulneración
-.
Asimismo, se concluye que el razonamiento de la Corte IDH es predominantemente cisexista
y binaria y, a causa de ello, realiza una lectura sobre las víctimas como sujetos de protección
desde una visión cisnormada que excluya a quienes también se encontraban en una situación
similar de vulnerabilidad debido a su capacidad para gestar (personas asignadas mujeres al
nacer, intersexuales, hombres trans, entre otres).
This report focuses on the limitations observed in the jurisprudential development of the InterAmerican Court of Human Rights (hereinafter referred to as the IACHR) to expressly recognize persons with the capacity to gestate who do not identify themselves as heterosexual cisgender women through the review of the judgment in the case of Artavia Murillo and others vs. Costa Rica. The analysis is complemented by the review of judgments that deal with the violation of rights of LGBTIQ+ people and sexual and (non) reproductive rights - which recognize cisgender women above all as main affected by their violation -. Likewise, it is concluded that the reasoning of the IACHR is predominantly cisexiste and binary and, because of this, makes a reading on the victims as subjects of protection with a cisnormada vision that excludes those who were also in a similar situation of vulnerability due to their ability to gestate (persons assigned women at birth, intersex, trans men, among others).
