This article will analyze the harmful effects of the concession model in the Peruvian railway sector when trying to promote competition in a downstream market. The general objective is to analyze and describe these negative effects. As a hypothesis, it is suggested that the concession model has had a detrimental impact, forcing inefficient competition in the railway market. To this end, the study of the characteristics and regulatory framework of the concession in the Ferrocarril Sur Oriente (FSO) is essential, while the specific objectives seek to evaluate these aspects. Finally, it is concluded that there are limitations in competition, regulatory inadequacy and lack of convenience in the FSO competitive process. In this sense, the first part addresses the privatization process in the context of hyperinflation and economic crisis, focusing on the railway sector and specifically on the FSO route. Concession models (vertical separation, horizontal integration, and competitive access) are explored and the importance of understanding the concept of downstream market in rail transportation is highlighted. The second part delves into the regulatory framework applicable to the promotion of private investment, seeking to understand the objectives behind the concession and its relationship with competition, examining whether improving the service or ensuring remuneration to the State was prioritized. Finally, the third part evaluates the convenience of the competitive process in the concession of the FSO, considering the economic context, competition factors and the adequacy of the criteria of the Concession Contract, questioning whether indepth studies on economic efficiency and social convenience were carried out. and exploring whether appropriate criteria were applied or based on foreign experiences, which could have become detrimental factors.
