The purpose of this paper is to analyze whether the telecommunications company Viettel Peru has incurred in acts of unfair competition in the modality of deception with respect to the diffusion in which “Unlimited Internet Plans“ are promoted. The Supervisory Commission in the first instance sanctioned the mentioned telecommunications company for engaging in acts of deception, since the complementary information of the advertising pieces makes reference to the fact that at a certain consumption ceiling the speed will be reduced. In view of this, the authority points out that it would be distorting the main message that necessarily alludes to providing download data and speed in an unlimited manner. In the same line, every advertisement to be analyzed must go through the well-known integral and superficial analysis, which has not been taken into account by the Commission, since the consumer would not have to expect that at a certain consumption cap there will be a degradation of the speed. Therefore, it is evident that the restrictions were warned in a timely manner, which must be known by a reasonable consumer who, based on the information provided, will freely decide whether or not to contract the plan offered by the telecommunications company
