This article addresses the challenges of the principle of procedural publicity in the context of virtual hearings in the Peruvian judicial system. It begins with a review of the importance of the rule of law and the evolution of the concept of procedural publicity from the perspective of civil liberties. National and international regulations that support this principle are examined, with special emphasis on the Political Constitution of the State and the Criminal Procedure Code. The analysis highlights the contradiction between the regulations and judicial practice, where publicity is limited to the procedural parties and not to the general public. Relevant cases in Peruvian jurisprudence that address this principle are explored, emphasizing its recognition at the national and international level. The second part of the article focuses on the specific challenges of virtual hearings, which emerged in response to the Covid-19 pandemic. Although it is argued that video conferencing is not unconstitutional, concerns are raised about public access to these hearings through platforms such as Google Meet. The lack of public access and its possible implications for the principle of procedural publicity are discussed. It concludes by proposing solutions, such as the creation of live broadcast channels of the hearings of each court. These channels would allow public access through the information media of the Judiciary, ensuring publicity of judicial proceedings. The article highlights the importance of these measures to preserve transparency, trust and citizen control in the Peruvian judicial system. This study provides an exhaustive reflection on the current challenges of procedural publicity in a context of virtual hearings, offering concrete proposals to improve the situation and guarantee the integrity of the judicial system in Peru.
