The current article pretends to introduce the main characteristics of the regularizarion process of state property, according to the rules of the National System of State Property and of the Narional Supply System. We will delve into the theoretical and practical implications that supposes the creation of a new administrative system, the distinction between “land” and “edification” and how that weights on the regularization process. To that purppose, we will perform a predominantly normative analysis of the laws, regulations and guidelines that regulate both systems, as well as the legal provisions that define regularization. As a complement, we wil reffer to other state entities that carry out acts of regularizarion to understand the range of this concept. Furthermore, we will identify the relevant elements that public entities must take into account for the elaboration of administrative documents that contain regularization acts, which will be subject to registry qualification, in order to achieve the main objective of the process: that the public registry reflects the current physical and legal situation of the land or edification through registration. Our research has found that the distinction between land and edification obeys operational purposes, which produces theoretical contradictions in the application of the regularizarion process; in other words, we will demonstrate that the norms of the National System of State Property, that should apply only to lands, also applies to edifications, despite belonging to the National Supply System, which can cause problems of interpretation and enforcement in the future.
