In resolution 580-2022-SUNARP-TR-L, the Registry Court of Lima has recognized the non-registrable nature of the assignment of hereditary property rights in the Registry of Intestate Succession; since its registration only takes place in the Property Registry. The object of the assignment of hereditary rights is the transfer of the right of participation over the hereditary estate, so that demanding a registry item on an individualized asset distorts the aforementioned object, and, consequently, what is being done in practice is nothing more than the transfer of ownership over assets. This generates restrictions to the assignee in the exercise of his position as a creditor, access to bank accounts, social benefits and economic rights due to copyright of the deceased. The present investigation offers a proposal for the normative interpretation of the Regulation of Registration of Wills and Intestate Succession and of the Land Registry, in order to consider it as a registrable act, regardless of any legislative modification. For all these reasons, I disagree with the decision of the Registry Court, since the registration in the Property Registry excludes legal situations unrelated to real rights from publicity.
