The legal protection of animals is a topic that is becoming more and more visible at the international and national level; either through regulations or jurisprudence. The legal status of animals and the rights or principles assigned to these living beings are some of the subjects of debates that have a common aspect in count: animal welfare. But, what happens when animal protection and welfare is confronted with other fundamental rights that people have? This legal report will analyze the judgment handed down in Case No. 00022-2018-PI/TC in which the unconstitutionality of the First Final Complementary Provision of Law No. 30407 - Animal Protection and Welfare Law is requested. An exception is made in this provision, because animals participating in bullfighting, cockfighting and other activities that are declared cultural by the Ministry of Culture are excluded from its legal protection. In this way, the constitutional and legal regulations related to the legal protection of animals will be analyzed, different jurisprudential pronouncements will be interpreted and doctrine will be used to determine whether or not such exception is unconstitutional. Specifically, we will address issues on (i) the legal status of animals in Peru, (ii) the development of the right to cultural identity as a basis for the exception of Law No. 30407 and, (iii) the regulatory development of bullfighting and poultry to determine whether there is compatibility and relationship with animal welfare.
