This case analyzes the judgment issued in Case No. 244 - 2014, in which the Second Commercial Chamber declared groundless the appeal for annulment based on the violation of the ground c) of numeral 1 of Article 63 of the Arbitration Law. This appeal for annulment was based on the fact that there had been a lack of deliberation by the Arbitral Tribunal. Thus, this paper answers three legal problems arising from the discussion on the lack of deliberation, i.e., the concept of deliberation in arbitration, whether the lack of deliberation is subsumed in the ground c) of paragraph 1 of Article 63 of the Arbitration Law and in which cases there is a lack of deliberation. The answers to these questions are based on an analysis of the arguments made by the Second Commercial Chamber on these three legal problems and on the Arbitration Law. Thus, the conclusions of this work are that deliberation in arbitration must be understood as an exchange of opinions and information by the entire Arbitral Tribunal regarding the evidence, pleadings, statements of the parties, arbitral proceedings and others that lead to a decision that will be the Award to be issued by the Arbitral Tribunal; the lack of deliberation is subsumed under ground c) and that there is no deliberation when there is a manifest action to exclude one of the arbitrators from the deliberations.
