The increase in mining activities in Peru and the world has occurred rapidly in recent decades, because of the dynamics of the world economy and the emergence of new global economic actor such as China. These activities have extended to the border lines, being a cause for concern for the possible risks that such operations imply and for the impacts and harms they could have on the well-being of people and the environment in the territory of the other country. For this reason, we analyze the decision adopted in the case between Costa Rica and Nicaragua by the International Court of Justice and the Advisory Opinion issued by the Inter-American Court of Human Rights at the request of Colombia, considering whose criteria we analyze the case of the Pucamarca mining project and the need to expand the scope of environmental management instruments to border activities and impacts on the territory of the other country.
