This article critically addresses the position of the National Institute for Consumer Defense (Indecopi) related to the illegality of subjective claims in comparative advertising in Peru. Thus, it is suggested that such statements should be allowed. To do this, the main concepts on commercial advertising, types and advertising claims are reviewed. Likewise, the history of the regulation of comparative advertising in Peru is described. Then, the main restrictions applicable to simple and comparative advertising in Peru are analyzed. Finally, the main arguments are presented for which subjective allegations should be allowed.
