Resumen: El presente informe jurídico analizará la controversia generada entre la empresa LUZ
DEL SUR S.A.A., contra la empresa ELECTROPERU S.A., respecto a la
determinación del precio tope aplicable a los excesos de energía contratada y
destinadas al servicio público de electricidad (regulación tarifaria), ello en atención
al CONTRATO DE SUMINISTRO PARA EL SERVICIO PÚBLICO DE
ELECTRICIDAD, suscrito el 16 de mayo de 1997. Pues bien, en el citado
expediente, LUZ DEL SUR S.A.A., en su calidad de empresa distribuidora de
energía, alega que los excesos de retiro de la energía contratada, al ser destinadas al
servicio público deben de ser facturados a Tarifa en Barra, argumento que es
rechazado por la empresa generadora, esto es ELECTROPERU S.A., razón por la
cual LUZ DEL SUR S.A.A., presenta una reclamación ante el OSINERG
(actualmente, OSINERGMIN), pese a que existía una cláusula arbitral de solución de
controversias acordadas por ambas partes; motivo por el cual se analizará el
procedimiento y la competencia del Tribunal Administrativo del OSINERG para
conocer y resolver la controversia; adicionalmente a ello, se analizará el alcance del
servicio público de electricidad, bajo la relevancia de la aplicación de las Tarifas
Reguladas en los Contratos de Concesiones Eléctricas, específicamente en aquellos
donde la empresa prestadora de energía se ve en la necesidad de “excederse” en los
términos del contrato con la finalidad de poder cumplir con la prestación del servicio
público de electricidad; asimismo, se analizará la responsabilidad de la empresa
distribuidora ante dicho incumplimiento, bajo la perspectiva de la responsabilidad
extra contractual, al excederse en los retiros de la energía contratada y, finalmente
brevemente se analizará el actuar de LUZ DEL SUR S.A.A., bajo la Teoría de los
Actos Propios.
This legal report will analyze the controversy generated between LUZ DEL SUR S.A.A. and ELECTROPERÚ S.A., regarding the determination of the ceiling price applicable to the excess of contracted energy destined to the public electricity service (tariff regulation), in accordance with the SUPPLY CONTRACT FOR THE PUBLIC ELECTRICITY SERVICE, signed on May 16, 1997. In the aforementioned case, LUZ DEL SUR S.A.A., in its capacity as energy distribution company, alleges that the excess withdrawal of contracted energy, since it is destined to public service, should be billed at the Bar Rate, an argument that is rejected by the generating company, ELECTROPERÚ S.A., for which reason LUZ DEL SUR S.A.A.A. filed a claim before the OSINERG (currently, OSINERGMIN), despite the existence of an arbitration clause for dispute resolution agreed by both parties; for this reason, the procedure and competence of the Administrative Court of OSINERG to hear and resolve the dispute will be analyzed; Additionally, the scope of the public electricity service will be evaluated, under the relevance of the application of the regulated tariffs in the electricity concession contracts, specifically in those where the energy company is forced to “exceed“ the terms of the contract, in order to comply with the provision of the public electricity service. Likewise, the liability of the distribution company for such breach will be analyzed under the perspective of the non-contractual liability for exceeding the contracted energy withdrawals; finally, the actions of LUZ DEL SUR S.A.A. will be briefly examined under the theory of its own acts.
