Abstract: Este informe cuestiona y analiza la Resolución Nº 451-2020-SUNARP-TR-L, en relación
a la calificación registral, la cual no advierte la incompatibilidad entre el título presentado
y el antecedente registral. Asímismo, el Tribunal Registral ignora al calificar la aplicación
de las normas competentes al acto rogado. Finalmente, sostengo que, la especialidad
funciona como una herramienta de la calificación registral del folio real en nuestro
sistema registral y no como un principio registral.
This report questions and analyzes the Resolution Nº 451-2020-SUNARP-TR-L, in relation to the registry qualification, which doesn’t warn about the incompatibility between the title presented and the registry record. Likewise, the Registry Court ignores the application of the competent rules to the requested act. Finally, I argue that the specialty works as a tool of the real folio of the registry qualification in our registry system and not as a registration principle.
