Within the framework of public procurement regulations, in particular from the issuance of Legislative Decree N° 1017 until the compilation in the current Single Ordered Text of Law N° 30225, the legislator considered it pertinent to include in the section referring to the impediments to contract with the State, one related to spouses, partners or relatives, among others, of officials who occupy “high“ public positions, and this by virtue of certain degrees of consanguinity or affinity. Perhaps due to issues related to preventing conflicts of interest, avoiding acts of corruption or improper practices (highly favored), or perhaps for mere administrative convenience, the legislator considers that this impediment should remain in the applicable regulation. In this sense, the present research work has the general objective of analyzing the controversy of extending a prohibition –impediment– to contract with the State to persons who have a kinship bond with “high“ public officials, but above all that the measure has a national scope (absolute impediment), is in force during the entire time in which the said positions are held, and even up to twelve (12) months after they have been left (long-term impediment). It should be noted that the provision adopted turns out to be irrational and disproportionate, as well as violating fundamental rights, and even the principles that govern public procurement itself. Thus, it will be noted that there are other viable alternatives that are aligned with the regulatory framework of public procurement, and that can contribute to the prevention of the problem that has been warned by the legislator.
