This paper aims to analyze the case of Expelled Dominicans and Haitians vs. Dominican Republic, which was presented to the Inter-American Court of Human Rights and subsequently resolved on August 28, 2014; from the perspective of equality and non-discrimination. To this end, it will be demonstrated that the arbitrary expulsions constituted a serious violation of the victims' rights to identity, minimum procedural guarantees, childhood and family unity. It will also postulate the need to recognize that the sovereignty of States in matters of human mobility must be reformulated from the situation of vulnerability that is advocated for migrants. Also, it will be emphasized that, given the new challenges posed by migration, it is necessary to adopt an autonomous right to migrate that implies addressing migration as an inherent human activity. Finally, certain integration policies should be formulated to recognize migrants as favorable to host societies. In view of the above, dogmatic and exegetical methods will be applied in the present report, where the study of the international norms and standards offered by International Human Rights Law will be fundamental in attention to the protection of migrants.
