The objective of this work is to determine the legal viability of the declaration of nullity of an administrative contract, ex officio, by the arbitrators in the framework of the resolution of conflicts in State contracting, for which, it starts from the analysis of a specific case in which, in effect, an arbitral tribunal declared the nullity, ex officio, of an administrative contract on the grounds of an illicit purpose. The case resolution method is used, through the construction of the problem tree proposing a main question, as a legal problem to solve Then, other 3 questions to be resolved will be raised, referring to the competence of the arbitrators to rule on the validity of a contract; the nature of the administrative contract, and; to the fulfillment of the requirements for the declaration of nullity ex officio of the contract for illicit purpose, in the specific case. Finally, it will be concluded that the arbitrators will be competent to resolve null, ex officio, an administrative contract if the matter on the validity of the contract is arbitrable for the specific case and if the grounds for nullity provided for in article 219 of the Code Civil are met.
