Abstract: Conforme a lo resuelto por la sentencia de la Segunda Sala Comercial en el recurso de anulación
de laudo interpuesto por Química Suiza S.A. contra Dongo-Soria, Gaveglio y Asociados S.R.L.
seguida bajo el expediente No. 155-2012, el presente informe analiza los siguientes dos problemas
jurídicos. En primer lugar, el presente informe analizará si es que el laudo arbitral objeto del
recurso de anulación de laudo vulneró el derecho a la prueba y a la debida motivación de laudos
arbitrales. Para ello, se evaluará el estándar de motivación de laudos arbitrales y las implicancias
del derecho a la valoración probatoria. En segundo lugar, se analizará si el laudo arbitral
cuestionado afecta el derecho a ser juzgado bajo los principios de independencia e imparcialidad,
debido a un viaje realizado por uno de los árbitros junto con el abogado de una de las partes del
proceso. A raíz de lo analizado, se plantea una propuesta con el objeto de solucionar los problemas
vinculados a la exigencia de un reclamo previo en el arbitraje como requisito de procedencia del
recurso de anulación de laudo arbitral, cuando ello no es posible por alguna razón.
Pursuant to the decision of the Second Commercial Chamber in the annulment of the award filed by Química Suiza S.A. against Dongo-Soria, Gaveglio y Asociados S.R.L. in case No. 155-2012, this report analyzes the following two legal issues. First, this report will analyze whether the arbitral award that is the object of the annulment of the award violated the right to evidence and the right to a reasoned arbitral award. To this end, it will evaluate the standard of reasoning of arbitral awards and the implications of the right to the evaluation of evidence. Secondly, it will be analyzed whether the arbitral award in question affects the right to be judged under the principles of independence and impartiality, due to a travel made by one of the arbitrators together with the attorney of one of the parties. As a result of this analysis, a proposal is made in order to solve the problems related to the requirement of a prior claim in arbitration as a requirement to procedural denial for the annulment of the arbitral award, when this is not possible for any reason.
