The purpose of this article is to analyze the standard of (dis)protection incurred by Law N°31096, “Law that specifies the scope of Law 28972, Law that establishes the formalization of land transportation of passengers in collective automobiles“ on the right to sustainable mobility of public transportation users in Peru, a right that is not yet explicitly recognized in our country but deserves special attention as it is linked to fundamental rights for the development of people. The issue raised presents legal relevance in that, within the singular votes or the block vote of the Constitutional Court when deciding on the case of collective automobiles, the material defect regarding the violation of the sustainable mobility right of the users should have been developed, which would have allowed for more arguments in favor of the unconstitutionality of Law No. 31096. To this end, first, readers will be introduced to the key aspects for the analysis of the law in question. Secondly, I will analyze the material defect regarding the violation of the right to sustainable mobility of Law No. 31096. Thirdly, I will propose conclusions and recommendations based on the analysis.
