The purpose of this article is to determine whether the application of the legal regulations that regulate null dismissal due to pregnancy is valid, to the case of the worker who has suffered the involuntary termination of her pregnancy; since this particular event is not expressly provided for in article 29, literal e), of the LPCL. Thus, from a grammatical review of its normative content, it can be seen that this literal addresses the biological fact of motherhood, from an androcentric view of the law, which does not allow the reality of women to be made visible, that is, that not all pregnancies end in a successful birth. Taking into account the above, the article concludes that a corrective or extensive interpretation of the norm in question is necessary, through the use of two interpretation methods (systematic and logical); in order to avoid limiting the interpretive activity to the application of the literal method. Likewise, from both methods, it is deduced that the protection of null dismissal is validly extended to the worker who has suffered the natural loss of her pregnancy; protection that may even be demanded with greater intensity, meanwhile, the frustration generated in women brings with it a physical and psychological weakening that, in the event of a dismissal, may be exacerbated. Finally, it is concluded that, in the case presented, the additional request for compensation for damages is completely feasible, as there is evident moral damage to the person.
