The present investigation will focus on the Construction Contracts that are being studied more and more by the law, a contract that, due to the complexity and dynamism of the Engineering and Construction sector, must adapt to the technologies and procedures that are deployed in the same. In the same way, due to the fact that the application of Engineering does not usually give in an ideal and perfect way, it is that these contracts are exposed to various variations, the same ones that, before the imposition of conditions by the Principal, on various occasions the Contractor does not have contractual procedures that allow economic recognition of them, even more so when our Civil Code establishes a brief conceptualization of the Variations in the Work Contract. For this reason, through the application of the Case Study methodology and comparative legislation, the considerations that must be taken into consideration by the Legislator are raised, in order for a modification of Article 1775 of the Civil Code to be carried out. in order to mitigate the current asymmetry existing in the Construction Contracts between the Principal and the Contractor, as well as to maintain the economic balance between the participating parties, with the sole purpose of preserving their economic activity.
