Abstract

El presente trabajo de investigación fue intitulado ¿Por qué existe una mayor exigencia sobre el otorgamiento de facultades para la disposición de tierras comunales las cuales deben contener con precisión las características físicas del predio? Se buscó poder comprender y analizar la importancia de las comunidades campesinas como medios de desarrollo y la relevancia de que el registro adopte medidas adicionales en cuanto a la especificidad que deben tener en el otorgamiento del poder para disponer de tierras comunales. Siendo un mecanismo importante pero no suficiente para poder proteger la continuidad de las tierras comunales las cuales por su naturaleza constituyen una piedra angular para que este grupo de personas pueda seguir desarrollándose de manera individual y colectiva rescatando y valorando la identidad, cultura y tradiciones ancestrales que representan dentro de nuestra sociedad. Sumado a la muestra de lo que significa trabajar de manera recíproca y solidaria primando el bien común sobre el bien particular. Se llegó a la conclusión que esta rigurosidad debe venir acompaña de otras normas que evite que las tierras comunales desaparezcan en su totalidad siendo necesario reservar un porcentaje de tierra comunal que garantice la subsistencia de la comunidad campesina. Teniendo la Sunarp una función muy importante en la conservación y protección de las tierras comunales.

The present research work was entitled Why is there a greater requirement for the granting of powers for the disposal of communal lands which must precisely contain the physical characteristics of the property? The aim was to understand and analyze the importance of peasant communities as means of development and the relevance of the registry adopting additional measures regarding the specificity that they must have in granting the power to dispose of communal lands. Being an important mechanism but not sufficient to protect the continuity of communal lands which, by their nature, constitute a cornerstone so that this group of people can continue to develop individually and collectively, rescuing and valuing the identity, culture and ancestral traditions that represent within our society. Added to the example of what it means to work in a reciprocal and supportive manner, prioritizing the common good over the individual good. It was concluded that this rigor must be accompanied by other regulations that prevent communal lands from disappearing in their entirety, making it necessary to reserve a percentage of communal land that guarantees the subsistence of the peasant community. Sunarp has a very important role in the conservation and protection of communal lands.
