This article proposes a harmonized definition of environmental emergencies in the General Law of the Environment in Peru, based on the study of the Environmental Emergency Declarations (DEA) in a national and comparative context regarding the analysis of the Repsol case on the most significant oil spill. In the first and second section, environmental emergencies will be studied in a comparative and national context for the proposal of a harmonized definition that also considers what is regulated in specific regulations: Environmental Emergency Declaration; Declaration of Climate Emergencies; Declaration of Solid Waste Emergencies; Declaration of Water Emergencies in Act; State of Disaster Management Emergencies under SINAGERD; and environmental emergency reports under SINEFA. In this way, and evaluated the criteria for an environmental emergency declaration in the Repsol case compared to other cases not declared in the third section, it will be determined that in addition to the need for a harmonizer concept, it is necessary to establish greater multisectoral articulation of the information reported for the authorities, as well as to reflect on regulations that seek to optimize contingency plans, environmental insurance and the revocation of environmental certification as the ultimate sanction for failure to comply with administrative actions issued by the OEFA under the DEA.
