This Report will analyze the Judgment issued by the First Commercial Chamber on the claim for annulment of the award filed by KS DEPOR S.A. against Club Sporting Cristal, which was processed under File No. 00022-2016-0-1817-SP-CO-01. Specifically, an analysis will be made with respect to the first cause for annulment of the award presented by the claimant, linked to the alleged violation of the duty of independence and impartiality by two of the arbitrators by not having disclosed -in a timely manner- facts that violated these principles and of which the claimant became aware once the arbitration was completed. This cause was declared inadmissible by the Commercial Chamber for not having filed a prior claim, in accordance with the provisions of Article 63.2 of the Arbitration Law. On this basis, and in the first place, this report will analyze whether the requirement of having to file a prior claim, for the purpose of claiming the nullity of the award under the grounds b) and c) provided for in Article 63.1, must be met even when the lack of independence and impartiality is discovered after the arbitration. Secondly, the scope of the principles of impartiality and independence will be analyzed. And, finally, it will be determined whether or not the arbitrators did indeed violate the principles of independence and impartiality.
