The activities of the electrical distribution concessions are not exempt from illegal acts that affect the exercise of their main obligations. In fact, driver theft is an event that occurs frequently. Therefore, through Resolution of the Board of Directors No. 010-2004-OS/CD, said event has been classified as an event of force majeure that must be requested and, if applicable, approved by Osinergmin. The problem arises when the resolutions issued through administrative channels do not evaluate all the criteria established in the sectoral regulation. With this, the Administration does not generate legal certainty or predictability. Likewise, it is worth mentioning that even in some resolutions there is a lack of motivation, increasing the possibilities of arbitrary pronouncements. In this sense, the copulative analysis of the constitutive elements of force majeure with the greatest incidence in the element of irresistibility is proposed, considering particular evaluation criteria in each specific case by virtue of a relative impossibility. Under these premises, this legal report will use as normative instruments the Political Constitution of Peru, Decree Law No. 25844, Electricity Concessions Law, Supreme Decree No. 009-93-EM, Regulation of the Electricity Concessions Law; Law No. 27444, General Administrative Procedure Law; and the Resolution of the Board of Directors No. 010-2004-OS/CD, Directive for the Evaluation of Requests for the Qualification of Force Majeure for Transmission and Distribution Facilities; thus judgments of the Supreme Court of the Republic of Peru.
