Abstract: El laudo materia de análisis trata de un procedimiento de recepción de obra en
el marco de contratación pública. En este caso arbitral, la discusión se centró en
si es que la entrega física de la obra suponía su recepción conforme la Ley de
Contrataciones con el Estado y su Reglamento vigentes al momento de celebrar
el Contrato (Ley No. 26850 y Decreto Supremo No 084-2004). A nuestro parecer,
la recepción de la obra, regulada en el normativa de contrataciones con el
estado, supone la ejecución de un procedimiento establecido para determinar el
cumplimiento de las condiciones requeridas para la ejecución de la obra. En ese
sentido, la simple entrega física de la obra no puede interpretarse como la
recepción de la obra si no se ha cumplido con el procedimiento establecido.
The award subject of analysis deals with a procedure for the reception of works within the framework of public procurement. In this arbitration case, the discussion focused on whether the physical delivery of the work implied its receipt in accordance with the Law on Contracting with the State and its Regulations in force at the time the Contract was entered into (Law No. 26850 and Supreme Decree No. 084 -2004). In our opinion, the reception of the work, regulated in the contracting regulations with the state, supposes the execution of an established procedure to determine the fulfillment of the conditions required for the execution of the work. In this sense, the simple physical delivery of the work cannot be interpreted as the reception of the work if the established procedure has not been complied with.
