The analysis addresses the ruling related to the unconstitutionality process of the Peruvian Financial Services Usury Protection Act N° 31143, which regulates interest rates in the Peruvian financial system. The main legal issue identified is the inadequate consideration of the principles of consumer protection and financial inclusion by the Constitutional Court in its analysis. The research utilizes various constitutional principles and institutions, as well as other legal institutions, considering their jurisprudential and doctrinal development, and seeks to apply them in the Peruvian context. The critique focuses on the Constitutional Court's omission in not adequately considering the principles of consumer protection and financial inclusion in its analysis, highlighting the need for regulation that balances protection against usury with broad and fair access to formal credit. The main conclusions indicate that, although the norm is constitutional, its effectiveness is limited, and it could lead to unintended consequences such as financial exclusion and the rise of the informal market.
