The present paper aims to address the registry qualification of fictional administrative acts of conformity of work and declaration of factory; being that the evaluation of the fictitious administrative act in the registry office has exceeded the provisions of plenary session No. 93, second precedent: “Qualification of administrative acts “ and plenary session No. 100, sole precedent: “Application of positive administrative silence“. With this in mind, a brief description of the institute of positive administrative silence will be made from Law No. 29090, Law for the regulation of urban authorizations and buildings and its Regulations (hereinafter “Law No. 29090“) and then continue with the core of the academic work that is the analysis of the registration regulations, the precedents of mandatory observance mentioned above and the resolutions issued by the registry courts with the aim of being able to recognize the challenges presented by the qualification of a fictitious or presumed act of conformity of work and declaration factory, to develop possible reforms. Consequently, the present work has managed to develop 4 challenges in the registration qualification of fictitious acts of factory declaration and analyze the current trend in which said challenges are resolved through the registry courts.
