Resumen: En la presente investigación se realiza un análisis sobre el deber de idoneidad
de la Asociación Promotora Educacional JLN Hope del Perú, representante del
Centro Educativo Privado Hiram Bingham, en base a la devolución de la cuota
de ingreso a los señores Luna y Arce padres de la menor de iniciales C.M.L.A.
Para ello se utiliza lo mencionado por el Decreto Legislativo 1476, así como el
Decreto de Urgencia 002-2020, cuyos algunos artículos, en razón a la cuota de
ingreso, entran en vigor el 01 de marzo de 2021 junto con el Reglamento de la
Ley 26549 “Ley de Centros Educativos Privados”. Teniendo en cuenta lo
mencionado, se realiza un análisis tomando en consideración aspectos
relevantes presentes en el caso en cuestión, lo cual nos permite evaluar el
contrato firmado por las partes, así como el pronunciamiento del personal
administrativo de la asociación.
Como resultado del análisis, se tiene que la Asociación que actúa como
representante de la institución vulnera el deber de idoneidad, pero no
necesariamente en base al servicio brindado, sino al negar injustificadamente la
devolución de cuota de ingreso, a pesar de que la estudiante no continuaría con
sus estudios. Dicha vulneración a tal principio también se encuentra justificado a
la determinación de una cláusula abusiva presente en el contrato firmado por las
partes, como también la comunicación enviada por el personal administrativo de
la asociación que coloca a las partes denunciantes en una situación de
expectativa por la devolución.
In the present investigation, an analysis is carried out on the duty of suitability of the JLN Hope Educational Promotion Association of Peru, representative of the Hiram Bingham Private Educational Center, based on the return of the entrance fee to Messrs. As a result of the analysis, it is found that the Association that acts as a representative of the institution violates the duty of suitability, but not necessarily based on the service provided, but by unjustifiably denying the refund of the entrance fee, even though the student did not He would continue with his studies. Said violation of said principle is also justified by the determination of an abusive clause present in the contract signed by the parties, as well as the communication sent by the administrative staff of the association that places the complaining parties in a situation of expectation for the return.
