The purpose of this article is to enter into a little debated topic, such as the Consultation to the Supreme Court regarding the non-application of norms in the amparo process. It is curious that to date there are no major articles that analyze this controversial issue, which has gone unnoticed for many years. My purpose is to put on the table the debate on the need for the regulation of consultation at a constitutional stage, to evaluate how consultation violates constitutional principles and the very nature of the amparo process, and to question whether such regulation should be extinguished or maintained. In this article we will note that not everything is black and white, and that, despite the obvious inconsistencies that may be generated on the basis of the consultation and the violations that it may generate, it is necessary to maintain it in order to safeguard key principles of law, such as predictability and legal certainty. However, maintaining the consultation suggests important modifications to its regulation, which I will discuss in more detail in this paper.
