Resumen: El presente trabajo intenta abarcar el deber de idoneidad, el cual es un derecho
reconocido legalmente que tiene como objetivo velar por el cumplimiento de la
expectativa generada en el consumidor respecto al producto o servicio que se le
ha ofrecido dentro de la relación de consumo. Sin embargo, este deber no debe
ser analizado únicamente desde aquel punto de vista, sino también respecto de
las condiciones accesorias que se generan durante la adquisición de un producto
o servicio, tales como el hecho de proporcionar al consumidor un ambiente
seguro y buena atención. En ese sentido, a partir de un análisis profundo de la
Resolución No. 2508-2020/SPC-INDECOPI, y en concordancia con la legislación
nacional, doctrina y jurisprudencia administrativa relevante, se demostrará el
alcance del deber de idoneidad, la responsabilidad que tiene el proveedor frente
al mismo y los criterios que deben ser tomados en cuenta para determinar su
vulneración, dentro de los cuales encontramos la posición de vulnerabilidad del
consumidor, el cumplimiento de las expectativas del consumidor y que el
proveedor se haya encontrado en la mejor posición para proteger y/o asegurar
el deber de idoneidad. Con todos estos factores se podrá otorgar una respuesta
al problema jurídico principal del presente informe.
This paper attempts to cover the duty of suitability, which is a legally recognized right that aims to ensure compliance with the expectation generated in the consumer with respect to the product or service that has been offered within the consumer relationship. However, this duty should not be analyzed only from that point of view, but also with respect to the accessory conditions that are generated during the acquisition of a product or service, such as providing the consumer with a safe environment and good service. In this sense, based on an in-depth analysis of Resolution No. 2508-2020/SPC-INDECOPI, and in accordance with national legislation, doctrine and relevant administrative jurisprudence, the scope of the duty of suitability will be demonstrated, as well as the responsibility of the supplier and the criteria that must be taken into account to determine its violation, among which we find the position of vulnerability of the consumer, the fulfillment of the consumer's expectations and that the supplier has been in the best position to protect and/or ensure the duty of suitability. With all these factors it will be possible to provide an answer to the main legal problem of this report.
