The main purpose of this paper is to analyze the exclusion criteria of the theory of objective imputation, based on the legal reasoning carried out by the Supreme Court of Justice in the Appeal for Annulment No. 2124-2018-LIMA, covering the criminal proceeding followed against military personnel of the Peruvian Army for the crime of embezzlement by appropriation, where they would have coordinated and executed a series of actions with the aim of repeatedly and systematically appropriating the fuel assigned to two military units during the year 2006. The Supreme Court convicted the high command for failing to comply with their duties of control and supervision, despite having a position of guarantor, while the subordinate personnel were acquitted for maintaining limited competences and adopting neutral behaviors in the criminal actions. The methodology used for the development of this work consisted of the search, review and analysis of national legislation and jurisprudence, as well as national and foreign doctrine regarding the doctrinal positions on the most representative objective imputation criteria. After the analysis of the Appeal for Annulment, it is concluded that the decision to not apply the exclusion criteria of the principle of trust and the prohibition of the return of higher-ranking officers was adequate. On the contrary, in the decision to exclude subordinates from criminal liability, the pre-requisites for the application of the categories of prohibition of return and neutral conduct would not have been considered, in accordance with the approaches of objective imputation that have been adopted for the purposes of this paper, which deny the prohibition of return for those who hold a position of guarantor of protection.
