Informe Jurídico de la Sentencia del Tribunal Constitucional N° 00223-2015-AA/TC sobre la libertad sindical en el caso de los trabajadores de confianza

Abstract

El presente informe jurídico aborda la cuestión problemática del uso abusivo de la calificación de trabajador de confianza como límite para el ejercicio de la libertad sindical. Analiza el fuero sindical como mecanismo indispensable para el ejercicio de la libertad sindical y la utilidad de esta última en el cese colectivo. Como vía idónea para la tutela de este derecho se propone la vía de amparo. Para el análisis y sustento jurídico se recurre al corpus iuris internacional, que incluye a los convenios de la OIT, los pronunciamientos del Comité de Libertad Sindical, los pronunciamientos de la Corte IDH y otros estándares internacionales.

This legal report addresses the problematic issue of the abusive use of the qualification of trusted worker as a limit to the exercise of freedom of association. It analyzes the fuero sindical as an essential mechanism for the exercise of union freedom and the usefulness of the latter in the collective dismissal. As an ideal way to protect this right, the amparo route is proposed. For the analysis and legal support, the international corpus iuris is used, which includes ILO conventions, the pronouncements of the Committee on Freedom of Association, the pronouncements of the Inter-American Court and other international standards.
