The purpose of this Report is to analyze the judgment of the Constitutional Court handed down on file N° 03066-2019-PA/TC, in the process followed by the Chila Chambilla and Chila Pucará Communities, through which said collegiate body affirms that the right to prior consultation is not a fundamental right in the Peruvian legal system, and, consequently, declares the claim inadmissible. For this purpose, in order to determine if the decision adopted by the Constitutional Court violates the alleged right to prior consultation, it will analyze, on the one hand, the grounds for inadmissibility of the amparo claim regulated in the Constitutional Procedure Code, and, on the other hand, the correspondence of the application of the right to prior consultation for the claimant Communities, taking into account both the constitutional norm, as well as the treaties, jurisprudence and binding opinions of international organizations, which are mandatory for Peru. Thus, from the analysis of the aforementioned legal tools, it will be demonstrated that the case addressed by the Constitutional Court was not in any case of procedural inadmissibility, as well as that it should have been declared wellfounded, since, according to the law In Peruvian law, in accordance with applicable international standards, the right to prior consultation of the claimant Communities should have been guaranteed
