The following legal report analyzes whether the decision of Cassation No. 2179- 2013-Ica issued by the Permanent Civil Chamber of the Supreme Court of Justice of the Republic, adequately protected the Principle of the Best Interest of the Child and the gender approach by declaring the cassation appeal unfounded. The normative instruments analyzed include General Comment No. 14-2013 of the United Nations Committee on the Rights of the Child and Law 30466, which establishes parameters and procedural guarantees for the primary consideration of the Principle of the Best Interest of the Child, together with its 2018 regulation. Also, the instruments in force at the time of the case are analyzed, such as the Convention on the Rights of the Child and Advisory Opinion No. 17 of 2002 of the Inter-American Court of Human Rights. Likewise, the Brasilia Rules and the Protocol for the Administration of Justice with a Gender Approach for Peru are analyzed. Finally, the main conclusions of the report indicate that the Court's decision did not adequately protect the Principle of the Best Interest of the Child, since the elements and procedural guarantees associated with this principle were not adequately assessed. Furthermore, the decision identifies a gender stereotype when evaluating the mother, which contrasts with the positive consideration of the role of the father. In conclusion, the Court did not correctly apply the regulations in force to ensure the Principle of the Best Interests of the Child at the time of rendering its decision, and reflected a gender bias that affected the fair evaluation of the case.
