The present research addresses the issues arising from the publication of Law No. 31590 and its effectiveness when applied to judicial proceedings concerning shared custody and its connection with the best interest of the children and adolescents. For this, the study examined the criteria that were modified for the judicial granting of custody in consideration of the best interest of the children and adolescents and the protection of their fundamental rights. Regarding the methodology, this is a qualitative explanatory study because it develops the concepts of the legal institutions addressed in this work, using relevant case law from the Supreme Court of Justice, ongoing judicial proceedings, and interviews with judges, legal specialists, and litigating attorneys related to the research. Additionally, it is correlational, because determines the relationship between the variables, concluding that the application of Law No. 31590 is not effective in custody proceedings, as no additional criteria have been established compared to those already developed under the previous regulation that favor the best interest of the children and adolescents.
