This thesis aims to develop the figure of political prejudice as a matter of criminal law, in relation to the crime of collusion and scope of protection that figure could provide. The investigation focuses on the development of the figure of political prejudice, the separation of powers, the development of the principles of jurisdictional exclusivity, due process and the crime of collusion itself. It is a descriptive study only, it does not delve into causal or correlational interrelations between legal figures; likewise, it is constituted with the verification of the basic theoretical positions for the knowledge of the subject. Throughout the investigation, the categories that have emerged from the research question formulated are evidenced, which are: the content of political prejudice, the paradigm of separation of powers, the principle of jurisdictional exclusivity, the principle of due process. Inferring that the political prejudice, becomes the nerve point of the investigation, since it seeks to establish and define its content according to the other categories of subject matter of study and analysis in the present investigation.
