The purpose of this research is to analyze whether the regulation of the judicial process of conventional separation and subsequent divorce is adequate, since there is no litigation and / or conflict in the claim of the spouses-plaintiffs, it would not be correct that it is processed in the process. judicial by the rules of the summary process that corresponds to a contentious process, even more so if this same claim is possible to process in the Notarial headquarters and in the Municipal headquarters and this is possible since there are no lawsuits in the applicants and because said offices do not process processes contentious, so that if this is the case, the procedural route of the judicial process of conventional separation and subsequent divorce would be inappropriate.
