La formalización laboral y la prevención de contingencias económicas en la empresa inversiones Efren EIRL, Trujillo 2017

Abstract

RESUMEN La presente investigación trata de la formalización laboral y la prevención de contingencias económicas en la empresa INVERSIONES EFREN E.I.R.L. Esta tiene como actividad principal la preparación de alimentos (restaurante) y se ha hecho más conocida por la preparación del plato tradicional de los andes, que es el cuy. La investigación es descriptiva, la informalidad laboral trae como consecuencias contingencias económicas, como las multas, embargos, costas, costos. En la empresa se identificó unas series de problemas con respecto a la informalidad, no ingresan a todos sus trabajadores en planilla, no reciben ningún beneficio laboral, trabajan días feriados sin pago de acuerdo a Ley, además no tienen un contrato laboral cuando este resulta exigible. Finalmente se realizó una comparación de los costos que genera la formalización según las normas laborales y las contingencias que genera la informalidad laboral al empleador. En los resultados obtenidos, se evidenciaron diferencias significativas en las contingencias económicas que tiene que asumir el empleador. Es por ello que se recomendó a la empresa incorporar a todos sus trabajadores en planilla y de este modo evitar multas por infracciones laborales o sanciones judiciales. ABSTRACT The present investigation deals with the formalization of labor and the prevention of economic contingencies in the company INVERSIONES EFREN E.I.R.L. This has as its main activity the preparation of food (restaurant) and has become more known for the preparation of the traditional dish of the Andes, which is the guinea pig. The investigation is descriptive, the labor informality brings as consequences economic contingencies, such as fines, seizures, costs, costs. The company identified a series of problems with respect to informality, they do not enter all their workers on payroll, they do not receive any work benefit, they work holidays without payment according to the law, they also do not have a labor contract when this is required. Finally, a comparison was made of the costs generated by the formalization according to labor standards and the contingencies generated by informal employment to the employer. In the results obtained, there were significant differences in the economic contingencies that the employer has to assume. That is why it was recommended to the company to incorporate all of its workers into payroll and thus avoid fines for labor infractions or judicial sanctions.
