La conducta deshonrosa y su exigencia de hacer vida en común como causal de divorcio y la tutela jurisdiccional efectiva en la corte superior de justicia de la Libertad, 2018 – 2020

Abstract

La presente investigación se ha realizado un análisis al divorcio por la causal de conducta deshonrosa que haga insoportable la vida en común con el objetivo de Determinar en qué medida la exigencia de hacer vida en común como supuesto de acreditación de la causal de conducta deshonrosa afecta la tutela jurisdiccional efectiva del cónyuge agraviado en la Corte Superior de Justicia de La Libertad 2018-2020.

Para ello en el primer capítulo denominado introducción se explica de manera clara la realidad problemática del tema en cuestión, antecedentes de la investigación se desarrolla el marco teórico referente al tema, se formula el problema, se determinó como objetivos a analizar. Asimismo, se desarrollaron entrevistas con 10 profesionales especialistas en el área estudiada conformados por 02 magistrados y 08 abogados litigantes con el objetivo de obtener opiniones sobre la problemática planteada y poder confrontarlas con los resultados obtenidos. Sumado al análisis de los pronunciamientos emitidos por la Corte Suprema y Tribunal Constitucional sobre el tema bajo estudio.

En tal sentido, luego de realizar el análisis teórico pertinente y la contrastación del mismo con la realidad se arribó como conclusión principal que la exigencia de hacer vida en común como supuesto de acreditación de la causal de conducta deshonrosa afecta la tutela jurisdiccional al cónyuge agraviado en la Corte Superior de Justicia de La Libertad 2018-2020., hecho que reafirma la hipótesis planteada.

This research has carried out an analysis of divorce due to the cause of dishonorable conduct that makes life together unbearable in order to determine to what extent the requirement to live together as an assumption of accreditation of the cause of dishonorable conduct affects the effective judicial protection of the aggrieved spouse in the Superior Court of Justice of La Libertad 2018-2020. For this, in the first chapter called introduction, the problematic reality of the subject in question is clearly explained, the background of the investigation develops the theoretical framework regarding the subject, the problem is formulated, it was determined as objectives to be analyzed. Likewise, interviews were carried out with 10 specialized professionals in the studied area, made up of 02 magistrates and 08 trial lawyers in order to obtain opinions on the problem raised and to be able to confront them with the results obtained. Added to the analysis of the pronouncements issued by the Supreme Court and Constitutional Court on the subject under study. In this sense, after carrying out the pertinent theoretical analysis and contrasting it with reality, the main conclusion was reached that the requirement to live together as a case of accreditation of the cause of dishonorable conduct affects the jurisdictional protection of the aggrieved spouse in the Superior Court of Justice of La Libertad 2018-2020, a fact that reaffirms the hypothesis raised.
